I am not a lawyer, I am a tree farmer and have spent 20 years and three days sitting in a courtroom to understand what the constitutional right to protect property means, and how to apply it to my property.  Currently the state of Iowa has had no objections to my method of "protection property" under the Iowa constitution but your results may be different.  No person who has used this information has ever been charged with any violation of Iowa state laws.  You may want to contact a lawyer on this issue.

Be sure you have read and understand all of this web site especially the part on the depredation program.  If you have any deer damage first contact your state Rep. and Senator tell them about your damage and ask them to legislate deer to a fur bearing animal.

If any state official ever asks you to spend any of your time or money (fences, repellants, dogs ect.) to prevent their deer or any government animal from destroying your property, ask them if they are going to pay you to do it.  If they say no (or refuse to answer) quote section 23 of the Iowa constitution of your right not to be a slave and refuse to do it, but ask that they spend their time and money to remove their deer, erect and maintain a fence, or pay you for damages to your property. (they will refuse or not answer).  Offer only to shoot all deer year around as this is the only effective way to stop deer damage, to your property.

Remember the DNR will always say you need to put up a fence to protect your property.  The Iowa Supreme court has said it is legal to shoot deer to protect our property.  So what the DNR is saying is they want you to put up a deer fence (at our expense) to protect their deer.  They think we are stupid and will do as they say because most people do not know the truth.

  First of all I would like to state I made four mistakes on my first case, here they are so you know now, what I do.

1.  I talked to the depredation/law enforcement officers on the phone and in person at his office without recording our conversations.  Never do this, use E-mail only, if he/she calls you, tell them to E-mail all information and do not talk to them on the phone or in person unless you are video taping and recording them, yes it legal. 

2. I had a depredation officer out to my farm and talked to him without video and audio recording our conversations.

3.  Depredation officers gave me written information that I did not have them sign every page with their signature to show it came from them.

4.  I should have taken more pictures of deer damage of my property and made sure I had the correct date on the pictures.

A.  Over 90% of the people that have used this information provided, shoot deer to protect their property without telling anyone, as there is no law requiring you to notify anyone to use your constitution rights to protect your property..  They have read the Depredation program and have found out that they do not qualify for the depredation program or do not want to participate.   They have taken lots of deer damage pictures (10 or more), and have damages of over $28.  They know what to say if any DNR law enforcement official comes to their door or confronts them anywhere. (see depredation page).

B.  This is what I did in 2007, contact your depredation officer by E-mail (see depredation page).  Tell them you do not qualify or do not want to participate in the deer depredation program, have had substantial damage to your property (over $28), and tell them you want to stop the deer damage to your property as guaranteed under the Iowa constitution, "right to protect property".  Ask them if they will remove the deer from your property, pay for the damage to your property or erect and maintain a fence to keep the deer off your property.

They may not respond to your request as they will know you have see this web site and know what to do.  Just send it three times if you get no response.  If they do respond and answer the above question, and say you may qualify for the depredation program and you want to participate. First ask them how they figure damages to your property, you may have to ask them several times but have this determined before they come out.  If they do not come out I suggest you send a certified letter to your County Attorney (County attorneys do all prosecution for the Iowa DNR and they are "very careful" now who they try to prosecute under a persons right to protect property and is why no one has been prosecuted by them, for the last 14 years) and E-mail a copy to your DNR law enforcement officer in your county, State Senator and Representative, with the below statement:

 Effective immediately I or persons authorized by me will be removing "killing" deer on my private property "as necessary" to protect my property under the Iowa constitution section 1 and Iowa Supreme court ruling # 30221.  The state of Iowa has refused to remove their deer, pay me for deer damages to my property, or erect and maintain a fence to keep deer off my property. 

This will be in effect for as long as deer may damage my property. If for any reason you do not approve of my method of "protecting property", please submit a program that will do that and not violate section 23 of the Iowa constitution.  No part of the deer will be used by myself as I protect my property from further deer damage, if you want the deer you are welcome to remove the deceased animals.

C.  If you have over $1000 damage or if the DNR Depredation officer comes out to your property to look at your deer damage be sure you are ready.  Ask for a copy of all of the names of other persons in your county that have participated in the depredation program. This is public information and they have to give it to you.  Set up a time for them to come, and have at least two other person as witnesses, and invite others who have participated in the program in the past, along with your county attorney and state Representative and Senator.

Tell them you will be video and audio recording him while he is at your place as you are dealing with a constitutional right to protect property.  Ask him how he figures damages to your property and ask him to put it in writing.  Ask several times "will your program stop the deer damage to my property", they usually will not give you an answer to this question, because it does not.  Be sure to get this on tape.

Take your time recording all the damage from deer on your property even if it takes quite a bit of time, the DNR may want to rush threw it or just say you qualify without looking at any damage, as they do not like to be video taped with any deer damage. Ask them three times on tape to view the damage if they do not want to see it.  Ask them to put the damage amount down on a sheet of paper with their signature and give it to you and have it on tape.  If they do not view any or all the damage always say "I believe I have had over $5000 in damage so far this year". On tape of course. 

If you qualify for the depredation program ($1000 damage) first ask them for the same program that the DNR uses for the city of Iowa City, (free, with rifle and spotlight) they may say no or nothing.  Then ask them for 50 rifle shooting permits, each year, ($2 each) which lets you shoot deer year around and any sex, they will probably say no.  If they offer depredation permits for shooting does only during hunting season, again ask them how this program will stop the deer damage to your property since only 1/2 of the deer can be removed.  They usually will refuse to answer.  Remember everything on video and audio tape

If you enroll in the depredation program, be sure to get on tape that you will withdraw from the depredation program if their program does not immediately stop the deer damage to your property.  Be sure to write this on the form you will be required to sign to enter the program.

D.  If you are currently in the depredation program and it has not stopped the deer damage to your property, E-mail your depredation officer this fact and ask them for 50 or more rifle shooting permits each year, for all deer, that can be used year around.  If they say no, tell them you are withdrawing from the depredation program and are now going to use your right to protect your property and will be removing deer year around, in accordance with Iowa Supreme Court ruling 30221.  Then send a letter to your county attorney and county DNR law enforcement listed above in section B.

 I am sorry that we do have to use the above tactics on our DNR and State officials, but until they acknowledge that Private Property Owners can remove any destructive state animals at any time to protect our property, it will be necessary to follow the above procedures.
